More work is required in Scotland to promote mediation for the resolution of commercial disputes. Mediation has traditionally been perceived as a method appropriate for resolving only family, employment and community disputes.
There are three key steps that must be taken to increase commercial mediation in Scotland: educating the commercial community, developing the mindset of commercial lawyers, and increasing the number of commercial mediators.
Universities can play a key role in all three steps. Education in the principles and practice of mediation, both at undergraduate and professional postgraduate levels, is crucial.
