Alternative dispute resolution has existed in Thailand for decades. ADR in Thailand is driven by the Court of Justice, rather than private organizations or parties. The Court has long recognized the importance of ADR and in 1990, established the Arbitration Office, subsequently transformed into the ADR Office.

ADR programs, especially court‐annexed mediation, have demonstrably reduced the number of cases that go to trial in Thailand’s courts. Mediation is viewed as an appropriate solution for the challenges caused by case backlogs.
